1.2 This privacy policy will help you understand what information we collect, how and why we collect that information, when we might disclose that information to third parties, how that information is stored, and how you can access and correct that information.

1.3 This privacy policy does not limit or exclude any rights that you have or may have under the Privacy Act 2020 (Privacy Act).

1.4 By using the products and services (Products and Services) offered by the Company, engaging in our activities or otherwise providing us with your personal information, you consent to the collection, use, disclosure, storage, and processing of your personal information in accordance with this privacy policy.

2. What Personal Information We Collect

2.1 Personal information is information about an identifiable individual.

2.2 The type of personal information we will collect about you may include:

(a) Clients accessing our Product and Services (including prospective clients): your name, age, date of birth, contact details, family details, employment details, your financial information (including assets, liabilities, income, outgoings, spending patterns, credit history, credit reference reports and property valuations), your tax file number, your insurance details, your credit card and banking details, information relating to a will or estate, references, copies of photo identification and other information necessary to provide our services;

(b) Contractors, service providers and business associates: your name, contact details and information relevant to obtaining third party services or providing our services;

(c) Applicants for a job with us or with one of our franchisees: your name, contact details, job applications, references and other information relevant to assessing applicants;

(d) Applicants as a franchise: your name, age, date of birth, contact details, family details, employment details, your personal financial information and your business financial information, your insurance details, your credit card and banking details, your resume, references, copies of photo identification, results of police or background checks, interview notes, and other information necessary to provide our services;

(e) Visual Information: including images or video footage captured by CCTV cameras at our premises or during property viewings (where disclosed by signage) for the safety and security of our staff, clients, and property.

2.3 If you choose not to provide your personal information when we ask for it, then we may be unable to provide you with the Products and Services, employment, recruitment as an agent or franchise.

3. How we Collect Personal Information

3.1 We may collect personal information about you:

(a) directly from you;

(b) from third parties; and

(c) from publicly available sources.

Directly from you

3.2 We collect personal information directly from you when you:

(a) Meet with one of our agents or visit an LJ Hooker office;

(b) Visit our website;

(c) Enquire about a property or our services including at open homes;

(d) Enter promotions or competitions, interact with our advertisements or participate in a survey;

(e) Contact us with an enquiry or complaint;

(f) Register, or hold an account with us; and

(g) Inquire about recruitment as an agent, franchisee placement, employee and for contracting purposes.

From third parties

3.3 We may collect personal information directly about you from the following third parties:

(a) our LJ Hooker Franchisees for purposes of administration of Franchise Agreements;

(b) from Strata Management or bodies corporate, on-site managers, and from vendors, buyers, landlords, and tenants;

(c) from third party entities such as credit reporting agencies, law enforcement agencies (for criminal records checks), and other government entities;

(d) from your representatives (e.g. solicitor, accountant or financial adviser);

(e) from our related bodies corporate; and

(f) from companies who use tracking technologies and web beacons to serve ads on our behalf.

4. Why we Collect Personal Information

4.1 We collect your personal information for the following purposes:

(a) Open Homes: To ensure the security of the home and persons attending, to contact you regarding your interest in the property or other listings, and to provide feedback to our client. Provide name and contact details is a condition of entry.

(b) Buying, selling or renting a property: For identifying and verifying your identity, acting on your behalf, marketing the property, negotiating sales/rentals, and complying with the Property Agreement and applicable law.

(c) Other Reasons:

  • To interact with you and maintain business records;
  • To provide Property Services (appraisals, advertising, business broking, etc.);
  • For recruitment and contracting;
  • To provide you with information about services that may be of interest to you. You may opt out of receiving marketing communications from us at any time by using the ‘unsubscribe’ facility in our emails or by contacting our privacy officer directly;
  • To assess and improve customer service;
  • To protect and/or enforce our legal rights, including monitoring suspicious activity;
  • To comply with Anti Money Laundering (AML/CFT) compliance and other laws.

4.2 We will not collect your personal information for any other purposes, unless you have expressly consented to that purpose.

5. How we Share Personal Information

5.1 Unless authorised by you or under this policy, we will not disclose your personal information to any third party except where disclosure relates to the purposes for which it was collected or where required by law.

5.2 We may disclose your personal information to:

(a) Your agents or representatives;

(b) Our employees, contractors, franchisees, and service providers (including IT and mailing houses);

(c) Our professional advisers (lawyers, accountants, auditors);

(d) Utility, insurance, and valuation providers at your request;

(e) Real estate professional bodies;

(f) Regulators, law enforcement, and government agencies;

(g) Courts and dispute resolution providers; and

(h) Our specific service providers including: Cotality (CoreLogic), Homepass, ActivePipe, Hougarden, RentHomes, Agentpoint, Palace, Meta, VaultRE, and REINZ.

5.3 Currently, the following third-party providers are located overseas:

(a) Homepass, a mobile application used for managing open home registrations, located in New South Wales, Australia.

(b) ActivePipe, an automated email marketing and lead nurturing platform, located in Victoria, Australia.

(c) Agentpoint, a digital marketing and website development service provider, located in New South Wales, Australia.

(d) Meta, providing social media advertising services via Facebook and Instagram, located in California, United States; and

(e) VaultRE, a real estate CRM and property management software provider, located in Victoria, Australia.

5.4 Where we disclose personal information to third party providers overseas, we ensure their privacy policy aligns with New Zealand standards through due diligence or contractual reviews.

6. How we Hold and Protect Personal Information

6.1 We will take all reasonable steps to ensure the personal information collected is stored in a secure environment protected from unauthorised access, modification or disclosure.

6.2 We will hold personal information for as long as necessary to fulfil the purposes for which it was collected and otherwise permitted or required by law (such as record-keeping requirements under the Real Estate Agents Act 2008 and AML/CFT laws).

6.3 In the event of a privacy breach that we believe has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and any affected individuals in accordance with our obligations under the Privacy Act.

7. Rights to Access and Correct Personal Information

7.1 Subject to certain grounds for refusal in the Privacy Act, you have the right to access and request a correction to your personal information. We will require evidence of your identity before exercising this right.

7.2 If a correction request is reasonable, we will make the change. If we do not, we will take reasonable steps to note on the personal information that you requested the correction.

7.3 We may charge a fee for providing access to your personal information, which we will advise you of before actioning your request.

10.2 If any provision is found to be invalid or unenforceable, it will be deemed deleted, and the remaining provisions will continue in full effect.
